Our Terms & Conditions (“T&C”) outline the legally binding terms and guidelines established by Swim-Safe.

These terms govern the interactions and engagements of our swimmers and visitors with our swim school. It is essential to understand and adhere to these terms to ensure a safe and enjoyable experience for everyone involved.

Our T&C are tailored to meet the specific needs of our swim school to provide a clear legal framework for all interactions.

Swim-Safe School Rules​

These rules ensure a safe, respectful, and joyful learning environment for all our swimmers.​

👨‍👩‍👧 Supervision & Access

Children must be accompanied by a responsible adult to and from lessons

Only authorized staff and enrolled children may enter the pool area

Parents/guardians must remain outside the pool zone during lessons

No child may enter the pool without a qualified instructor present​

 

🛟 Safety First

No running, pushing, dunking, or rough play in or around the pool

Diving is strictly prohibited unless explicitly taught by the instructor

Children must stay within their designated swim zones

No child may swim alone

Children feeling tired, dizzy, or unwell must exit the pool immediately

All injuries or accidents must be reported to staff immediately​

 

🧼 Hygiene & Health

No swimming with open wounds, contagious illnesses, or recent vomitingS

pitting, nose-blowing, or urinating in the pool is strictly prohibited

No eating, drinking, or chewing gum in the pool area​

 

👕 Dress Code & Equipment

Proper swimwear is required (no underwear or street clothes)

Swim caps are encouraged

Floatation devices may be used only with instructor approval

Goggles must be properly fitted

No glass containers, sharp objects, or pets allowed near the pool​

 

📦 Personal Belongings

Swim Safe is not liable for lost or stolen items

Label all belongings clearly​

 

🚨 Emergency Protocol

Instructors are trained in CPR and emergency response​

 

💬 Respect & Conduct

Children must listen to instructors and follow directions

Disruptive behavior may result in temporary removal from the pool

Bullying, teasing, or exclusion is not tolerated

Swim-Safe Swim School Terms & Conditions​

​Welcome to Swim-Safe Swim School (“the School”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) outline the rules, responsibilities, and expectations for all swimmers, parents, and guardians (“you”, “your”) participating in our swimming programs and using our services.By enrolling in any of our programs, attending lessons, or using our online platforms, you agree to comply with these Terms. Please read them carefully.​

1. EligibilityChildren must meet the age and ability requirements for their enrolled class level.Parents or guardians must complete all registration and medical forms before the first lesson.Participants must be medically fit to swim. Any medical condition that may affect participation must be disclosed during registration.We reserve the right to refuse or terminate enrolment if we believe participation poses a safety risk.

2. Enrolment & Class PlacementClass placement is based on the swimmer’s age, ability, and instructor assessment.We may adjust a swimmer’s level to ensure the best learning environment.Spaces are allocated on a first-come, first-served basis once full payment or deposit is received.

3. Payment PolicyLesson fees must be paid in advance before the first class of the term or package.Payment confirms your booking. We cannot hold a space without payment.Fees are non-refundable, except in cases of extended illness (with a valid medical certificate) or program cancellation by the School.We reserve the right to review and adjust pricing; any changes will be communicated in advance.

4. Missed Lessons, Cancellations & Make-UpsMissed lessons due to personal reasons (e.g., holidays, minor illness, scheduling conflicts) are non-refundable and non-transferable.Make-up lessons are subject to availability and must be arranged within the same term.Lessons cancelled by Swim-Safe due to unforeseen circumstances (e.g., weather, pool maintenance) will be rescheduled or credited.

5. Safety & ConductAll swimmers must follow pool rules and instructor directions at all times.Parents/guardians must supervise children before and after lessons.Appropriate swimwear is required; no jewelry or loose accessories are permitted in the pool.Aggressive, disrespectful, or unsafe behavior will not be tolerated and may result in removal from the program.

6. Health & Medical DisclosurePlease notify us immediately of any new or ongoing health conditions, allergies, or injuries.If a swimmer becomes ill or is suspected of having a contagious condition (e.g., ear infection, rash, diarrhea), they must not attend lessons until cleared by a doctor.The School and its instructors are not liable for medical incidents resulting from undisclosed conditions.

7. Photography & MediaWe occasionally take photos or videos during lessons for progress tracking or promotional purposes.You may opt out by notifying us in writing at registration.All images remain the property of Swim-Safe and may be used in marketing materials, unless consent is withdrawn.

8. Liability WaiverParticipation in swimming involves inherent risks.By enrolling, you agree that Swim-Safe Swim School, its instructors, and facility partners are not responsible for injuries, accidents, or loss of property occurring before, during, or after lessons, except where caused by proven negligence.Parents/guardians remain responsible for their child’s safety outside lesson times.

9. Program Updates & ChangesWe reserve the right to modify class schedules, instructors, locations, or lesson formats to maintain quality and safety standards.Any significant updates will be communicated in advance via email or our online platform.

10. Intellectual PropertyAll lesson plans, progress materials, digital content, and certificates remain the intellectual property of Swim-Safe Swim School.Reproduction or distribution without written consent is prohibited.

11. Account Suspension or TerminationWe reserve the right to suspend or terminate accounts or enrolments if:Payments are overdue;Safety or behavioral rules are repeatedly violated; orThere is misuse of our digital platforms or intellectual property.

12. Online Accounts & App UseParents may access swimmer progress, certificates, and communication through our Swim-Safe online app/portal.You are responsible for keeping your login credentials secure.Misuse of the platform (e.g., sharing private content) may lead to account suspension.

13. Privacy PolicyYour personal information is collected solely for the purpose of registration, communication, and safety management.We do not share your data with third parties, except where required by law or to process lesson payments.

14. Governing LawThese Terms are governed by the laws of the Republic of South Africa.Any disputes will be handled in accordance with South African law.
